香港特別行政區政府已就立法列明大厦業主立案法團購買第三者責任保險的詳細規定刊憲,該法例已於2011年1月1日正式開始生效,故所有已成立業主立案法團的大廈均需投保符合法例的第三者法律責任保障。新法例旨在減低一旦意外發生,業主須面對巨額賠償的風險,同時為公眾提供更好的保障。 |
規例中訂明受保一方是業主立案法團承保的第三者法律責任,將不會包括法例規定的僱員補償和合約責任,以免構成雙重保障。每份保單就第三者身體損傷或死亡的每次事件的最低承保額,不得少於港幣1,000萬元。保單的承保範圍須包括位於指明內地段的公用部分、建於內地段的建築物 (例如電梯 、樓梯 、消防裝置等,但不包括地基、排水渠、海堤、吊船、地底的公用裝置及僭建物),以及任何並非位於內地段但須由法團負責維修的土地範圍。法團須在保單承保的建築物或處所的當眼地點張貼投保通知書,以供所涉各方參考或查閱。 |
